Terms & Conditions
These Terms and Conditions govern your participation in the event: Step Up for Smart Works 2025. By registering for and participating in the event, you are agreeing to the below terms and conditions.
- You acknowledge that you will be contacted by email and post in relation to the event, ensuring Smart Works can deliver the necessary administrative and event-related communications required to complete your successful participation and fundraising for the event. This will include communications about: (a) Completing your registration for the event; (b) Training advice; (c) Fundraising tips and advice; (d) Information about how money raised by supporters is spent by Smart Works; (e) Motivational updates throughout the event; (f) Links to online Smart Works content relevant to your participation in the event; (g) Any communications necessary to ensure your successful participation and fundraising for the event; (h) Smart Works news that given your involvement in the event, may be of interest to you.
- Your personal data will be processed in accordance with Smart Works’ Privacy Policy. You acknowledge that where necessary, Smart Works will share your contact details with other third parties involved in the administration of the event. We will never share your data with any other third parties, unless you agree. You acknowledge that any photography or film footage taken as part of your participation in the event can be used for promotional and marketing purposes for this specific event and any future Smart Works events activity, including but not limited to promotion on Smart Works’ website and third-party websites, social media, in online and print media publications and other marketing materials. If you do not wish for your image to be used in this way, please contact the Smart Works team using the details below.
- You acknowledge this is a fundraising event and to the best of your ability, commit to raising the minimum sponsorship pledge as advertised on the Smart Works event webpage.
- When fundraising, you will act lawfully, not put undue pressure on people to sponsor you, or do anything that may harm the reputation of Smart Works or act in a manner contrary to our values. You must make it clear you are fundraising in 'aid of Smart Works' and are not representing that you are raising funds on behalf of Smart Works.
- For any independent fundraising events that you carry out to raise funds (such as a cake sale or pub quiz), you acknowledge that you are carrying such events out in your own capacity. It is your responsibility to organise all aspects of such event and make it clear that such event is run by you 'in aid of' Smart Works and is not run by Smart Works. You also agree to make it clear that such event is not 'on behalf of Smart Works' and that Smart Works will not accept any responsibility or liability for such event.
- You agree to ensure any required permissions or licences are obtained from the local authority or other relevant bodies, and permission is sought to use private property where required. You acknowledge you are responsible for obtaining any such licence and permission and this is not the responsibility of Smart Works. You also agree to comply with all relevant health and safety, food or drink, alcohol and gambling legislation and regulations.
- You acknowledge that Smart Works is unable to provide insurance for fundraising activity, and that you are responsible for securing appropriate insurance cover if required for your fundraising activity.
- You agree to ensure any cheques relating to your sponsorship are made payable to the relevant Smart Works centre you have chosen to support and sent to that Smart Works centre with the event name, your full name, and address. For more information, please contact the Smart Works team using the details below.
- You agree to send all sponsorship funds collected or raised to Smart Works as soon as possible and no later than ten weeks after the event. If sponsorship money was given on the condition you complete the event, and the event is cancelled, or you do not complete the event, then you should contact donors and ask if they are still happy for sponsorship monies to go Smart Works. If they do not wish for their sponsorship money to go to Smart Works in this circumstance, then the donation can be refunded to the relevant donors within six months. If the sponsorship money was given without any conditions attached, and the event is cancelled, or you do not complete the event, the money should be paid to Smart Works and there is no obligation to contact or confirm this with donors.
- The event which you are registering for is physically challenging. You need to be satisfied that you are physically capable of doing the event without undue risk to your health or life. We do not conduct health or fitness checks on entrants and the responsibility for your ability to participate in the event is with you as the participant.
- If you have a medical condition or are unsure of your physical ability to take part in the event, you must seek medical advice from a general practitioner prior to participating in the event. • All participants and spectators enter the event entirely at their own risk. We shall not be liable for any injury or loss to persons or their property that might occur as a result of your or their participation in or attendance at the event, other than in respect of any injury or loss arising as a result of our negligence. For the avoidance of doubt, nothing in this paragraph shall exclude or limit our liability for any liability that cannot be excluded or limited by law.
- These Terms and Conditions and any non-contractual obligations arising out of or in connection with them, are governed under English law. The courts of England shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms and Conditions.
